Terms of Service
The rules for using zelodata.com and the baseline terms that sit underneath public inquiries before a signed client agreement exists.
Acceptance of terms
These Terms govern your use of zelodata.com and the public information, forms, and resources we make available through the website.
By using this website, you agree to these Terms. If you are using the site on behalf of a company, you represent that you have authority to act for that company.
Paid client work is governed by the signed proposal, statement of work, master services agreement, or other written agreement between ZELODATA LLC and the client. If a signed agreement conflicts with these website Terms, the signed agreement controls for that client work.
What we do
ZELODATA LLC provides business-to-business marketing and web services, including SEO, Google Ads, Meta Ads, landing pages, website development, tracking implementation, reporting, and related consulting.
The website describes our services, pricing examples, process, and illustrative case studies. It does not create a binding offer, guarantee, agency relationship, or obligation to provide services until both sides sign a written agreement.
Website use rules
You may browse the site, link to it, quote short portions with attribution, and contact us about services.
- Do not attempt to interfere with, scan, overload, scrape at scale, or compromise the website.
- Do not use the site to transmit malware, spam, unlawful content, or false information.
- Do not copy the site design, code, content, brand, or case-study materials in a way that suggests affiliation with ZELODATA.
- Do not use our forms or contact channels to send unsolicited vendor pitches or automated messages.
Contact requests and communications
When you submit a request, email us, or book a call, you agree to provide accurate information that you are authorized to share.
An introductory call or preliminary recommendation is informational. It is not legal, accounting, financial, tax, or investment advice, and it is not a guarantee of marketing performance.
We may decline an inquiry or stop responding where the requested work is outside our scope, creates a conflict, appears abusive, or is not a fit for our team.
Client engagements
Client work starts only when both sides approve the scope, commercial terms, and start date in writing.
- Retainers are month-to-month unless a signed agreement says otherwise.
- Ad spend is billed directly by the advertising platforms to the client's own accounts unless a signed agreement says otherwise.
- The client owns its ad accounts, analytics accounts, domains, hosting accounts, and business data.
- ZELODATA may request access to client systems only to perform the agreed work.
- Scope changes, new channels, unusual integrations, or out-of-hours support may require a written change order.
Any service levels, launch dates, deliverables, refund terms, payment deadlines, or cancellation terms must be stated in the applicable signed agreement.
Pricing and payments
Prices shown on the website are informational and may change. A binding price exists only when included in an accepted proposal, invoice, or signed agreement.
Unless otherwise agreed in writing, invoices are due in U.S. dollars, taxes are the client's responsibility, and late or unpaid invoices may result in paused work or account handoff.
Website visitors do not pay through this website. We do not collect payment card information on zelodata.com.
Intellectual property
The website, logo, design system, copy, graphics, code, and other content on zelodata.com are owned by ZELODATA LLC or used with permission.
You may not reproduce, resell, frame, scrape, or create derivative works from the website content except as allowed by law or expressly permitted in writing.
For client deliverables, ownership and license terms are controlled by the signed agreement. Unless a signed agreement says otherwise, reusable methods, know-how, internal tools, templates, and pre-existing materials remain ZELODATA's property.
Results and case studies
Marketing results vary by market, offer, budget, competition, timing, tracking quality, and client follow-through. We do not guarantee rankings, ad costs, revenue, ROAS, conversion rates, or traffic numbers.
Case-study metrics, examples, and calculators on the site are informational and may be illustrative unless separately verified in a signed client reference or supporting documentation.
Privacy and cookies
Our Privacy Policy explains how we handle personal information. Our Cookie Policy explains the site's current cookie and tracking practices.
By using the website or contacting us, you acknowledge that we will process information as described in those policies.
Disclaimers
The website is provided on an "as is" and "as available" basis. We make reasonable efforts to keep the site accurate and available, but we do not warrant that it will be error-free, uninterrupted, secure, or complete.
To the maximum extent permitted by law, ZELODATA disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, ZELODATA LLC will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the website.
For website use, our total liability for all claims will not exceed USD $100. For paid client work, the liability cap in the signed agreement applies. Some jurisdictions do not allow certain limitations, so some limits may not apply to you.
Indemnification
You agree to defend and hold ZELODATA harmless from claims, damages, costs, and expenses arising from your misuse of the website, violation of these Terms, unlawful content you provide, or infringement of another person's rights.
Governing law and disputes
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules.
Before filing a claim related to the website, each side agrees to try in good faith to resolve the dispute informally by written notice and a reasonable discussion period. If that fails, the state and federal courts serving Sheridan County, Wyoming will be the exclusive venue unless applicable law requires a different venue.
Changes
We may update these Terms from time to time. The updated version will be posted here with a new last-updated date. Continuing to use the website after changes are posted means you accept the updated Terms.
